These Terms of Service ("Terms") govern your use of the Mona Lista mobile application and website (collectively, the "Service"), operated by Cullum Studio LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. You must accept these Terms before you connect any marketplace or social account to the Service.
Mona Lista provides tools for independent makers and e-commerce sellers to create product images, build marketplace listings, and prepare social media content. The Service is intended for use by individuals and small businesses operating legitimate e-commerce shops.
Important notice regarding third-party platforms: MONA LISTA IS SOLELY PROVIDED BY CULLUM STUDIO LLC (THE "APPLICATION DEVELOPER"). BY USING MONA LISTA TO CONNECT WITH THIRD-PARTY PLATFORMS INCLUDING ETSY, SHOPIFY, AMAZON, META, PINTEREST, AND TIKTOK, YOU ACKNOWLEDGE THAT THOSE PLATFORMS ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE MONA LISTA SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE MONA LISTA APPLICATION OR ANY DATA ACCESSED THROUGH IT. MONA LISTA IS NOT AFFILIATED WITH, ENDORSED BY, OR SPONSORED BY ANY OF THESE PLATFORMS.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account. We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms. Notify us immediately at hello@heymonalista.com if you suspect unauthorized access to your account.
The Service allows you to connect your marketplace accounts (such as Etsy, Shopify, and Amazon Handmade) and social media accounts (such as Instagram, Facebook, Pinterest, and TikTok) via OAuth. By connecting these accounts, you authorize Mona Lista to access and act on your behalf only as you explicitly instruct.
You retain full control over what content is published to your connected accounts. Before any content is posted, you are shown what will be published and must confirm it. Mona Lista will not publish, modify, or delete content on your behalf without your explicit instruction, and you may disconnect any connected account at any time.
Listings prepared for eBay are exported by you as a file and uploaded to eBay yourself; the Service does not connect to eBay through the eBay API and does not access eBay account data.
You are responsible for ensuring your use of connected platform APIs complies with the terms of service of those platforms. We are not responsible for actions taken by connected platforms, including suspension or termination of your accounts on those platforms.
We do not use data accessed from any connected platform for AI or machine-learning model training without your explicit written consent.
Etsy. When you connect your Etsy shop, these Terms constitute your Application Terms with Mona Lista as required by Etsy's API Terms of Use, and you accept them in a legally binding manner before connecting. We process your Etsy shop data only as a service provider to you, solely to provide the services you have authorized, and in compliance with all applicable privacy laws. The following disclaimer applies:
MONA LISTA IS SOLELY PROVIDED BY CULLUM STUDIO LLC (THE "APPLICATION DEVELOPER"). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
Shopify. When you connect your Shopify store, we access merchant data solely to provide our services to you, collecting only the minimum necessary. We comply with Shopify's data-protection requirements, including data deletion upon request, mandatory compliance webhooks, protected-customer-data handling, and compliance with applicable privacy laws including GDPR and CCPA. We do not use Shopify merchant or customer data to train AI or machine-learning models without your explicit consent.
Amazon. When you connect your Amazon seller account, we access seller data in compliance with Amazon's Selling Partner API Data Protection Policy, Acceptable Use Policy, and Solution Provider Agreement.
Meta (Instagram and Facebook). When you connect your Instagram or Facebook account, we use that access solely to publish content you explicitly direct us to post, and for no other purpose. We comply with Meta's Platform Terms and Developer Policies.
Pinterest. When you connect your Pinterest account, we use that access solely to publish Pins you explicitly direct us to post. We comply with Pinterest's Developer Guidelines and Developer and API Terms of Service, do not store Pinterest data beyond what is necessary to provide our services, do not combine it with data from other accounts or services, and handle any generated content in line with Pinterest's content and generative-content guidelines.
TikTok. When you connect your TikTok account, we use that access solely to help you post content you explicitly direct us to post. You are shown a consent confirmation before the content is posted and retain full awareness and control of what is posted through Mona Lista to your TikTok account. We comply with TikTok's Developer Terms of Service and content-posting guidelines.
You retain ownership of all content you upload to the Service, including product photos, descriptions, and other materials ("Your Content"). By uploading content, you grant us a limited license to use, store, and process Your Content solely to provide the Service to you.
You represent and warrant that you own or have the necessary rights to Your Content and that Your Content does not infringe the intellectual property rights or other rights of any third party.
We do not claim ownership of any content generated by the Service on your behalf. You own the outputs produced for you.
You agree to use the Service only for lawful purposes. You agree not to:
Access to the Service requires a paid subscription. Subscription fees are charged in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms.
We reserve the right to change subscription pricing with 30 days' notice. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
Payment processing is handled by Stripe. By providing payment information, you agree to Stripe's terms of service. We do not store your complete payment card information.
You may cancel your subscription at any time from within the app. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the period for which you have paid.
The Service, including its design, code, and branding, is owned by Cullum Studio LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE OUTPUTS GENERATED WILL MEET YOUR SPECIFIC REQUIREMENTS.
You are solely responsible for reviewing all content generated by the Service before publishing it to any marketplace or social platform. We are not responsible for any consequences arising from content you publish using the Service.
THE THIRD-PARTY PLATFORMS TO WHICH MONA LISTA CONNECTS (INCLUDING ETSY, SHOPIFY, AMAZON, META, PINTEREST, AND TIKTOK) ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE MONA LISTA SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO MONA LISTA OR DATA ACCESSED THROUGH IT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULLUM STUDIO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Cullum Studio LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any third-party platform's terms of service in connection with your use of Mona Lista.
We may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately and we will handle your data in accordance with our Privacy Policy.
We may update these Terms from time to time. We will update the effective date above, retain the prior version, and notify you of material changes by email or through the app. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New Mexico.
